The State Duma Amends the Law on Trademarks The State Duma approved on the second reading a draft law introducing amendments to the Law on Trademarks, Service Marks and Appellations of Origin of Goods at its Friday plenary session, RIA Novosti reports. Presenting this draft to the Deputies, an official of the State Duma's Committee on Economic policy and Business said that the aim of this document is to improve the Russian legislation on intellectual property. In particular, this draft law specifies the norms and procedures for trademark registration, grounds for registration denial and contesting the right to use a trademark as well as conditions, under which the use of a trademark may be considered an infringement. The draft law envisages the possibility of canceling the registration of the trademark if its registration is recognized to be a case of unfair competition or misuse by the rights holder. The draft regulation introduces a new liability provision for the breach of this law, which is destruction of the counterfeit product at the expense of the infringer. The provision on possible revision of the patent office ruling on the patent office's own discretion, without the initiative of any interested party, has been excluded from the language of the regulation, Lukhachov said. The Deputy underscored that the amendments to the law on trademarks bring it in compliance with the RF Constitution, agreements and treaties Russia is a signatory to as well as the RF Civil Code.
