Unofficial translation | Source: | AK&M | | Date: | October 25, 2002 | | Title: | The State Duma Approved on the Second Reading Amendments to the Law on Trademarks | On October 25, 2002, the State Duma approved on the second reading a draft law introducing amendments to the Law on Trademarks, Service Marks and Appellations of Origin of Goods. According to the draft law, the rights holder has the right to use the trademark and prohibit other parties from using it. One rights infringement is deemed to be the use of the trademark on goods, labels and packaging of these goods while operating and providing services on the Internet without the rights holder's permission. The expert opinion on the application is considered by the federal executive agency on intellectual property within two months starting from the application date. The rights holder and the owner of the certificate to use the appellation of origin has the right to demand that the party illegally using the trademark or the appellation of origin pays compensation ranging from 1,000 to 5,000 minimum salaries instead of claiming for damage compensation.
