DECREE No. 421

On Amendments and Additions to the Rules for Selling Isolated Types of Goods and to the Regulations for Licensing Reproduction (Manufacture of Copies) of Audiovisual Works and Phonograms of Any Media

The government of the Russian Federation rules:

Approve the following:

Amendments and additions to be included in the Rules for Selling Isolated Types of Goods, approved by RF government decree No. 55 dated January 19, 1998 (Collection of the Russian Federation Legislative Acts, No. 4, 1998, Article 482; No. 43, Article 5357; No. 41, 1999, Article 4923; and No. 6, 2002, Article 584); Amendment to be included in the Regulations for Licensing Reproduction (Manufacture of Copies) of Audiovisual Works and Phonograms of Any Media, approved by RF government decree No. 381 dated June 4, 2002 (Collection of the Russian Federation Legislative Acts, No. 23, 2002, Article 2181; No. 41, Article 3983).

In Brief
  • Retail sale of copies of audiovisual works and phonograms outside permanent selling spaces - at homes, in offices, institutes or schools, in vehicles, outdoors from stands or tents or other places - is not permitted.
  • Every copy of audiovisual work and phonogram must indicate the name and location of the producer, the number of the license, technical characteristics of the audio or video medium, as well as data about the holders of copyrights and related rights to the audiovisual works and phonograms. Vendors are also required to provide customers with the following information about copies of movies: the number and date of the rent certificate, movie title, country and studio that shot this movie and the year of its production, as well as basic movie characteristics, the length of the movie (in minutes) and a recommended minimum age for viewing.
  • When giving the product to a customer, the vendor shall check this product's packaging for integrity, and upon the request of the customer, the vendor shall let him/her watch/listen to parts of the audiovisual work or phonogram.
  • These requirements and terms are licensed, and their non-observance may lead to the cancellation of a license.


Amendments and additions to be included in the Rules for Selling Isolated Types of Goods, approved by RF government decree No. 55 dated January 19, 1998 (approved by RF government decree No. 421 dated July 12, 2003)

  1. Add the words "copies of audiovisual works and phonograms" to Clause 4, Paragraph 2 after the words "weapons and cartridges for them."

  3. The title of Section XII should read as follows: "XII. Specifics of Selling Copies of Audiovisual Works and Phonograms."

  5. 3. Clauses 90-93 should read as follows:

"90. Retail sale of copies of audiovisual works and phonograms from outdoor stands or tents is not permitted.

When selling copies of audiovisual works and phonograms, vendors are obliged to provide consumers not only with information stipulated in Clause 11 hereof but also with a product notice that is compulsory for every copy (package). This notice should include:

  • Name and location of the producer of the copy of an audiovisual work or phonogram, the number of the license for reproduction (manufacture of copies) of audiovisual works and phonograms;
  • Technical characteristics of the audio or video medium, and also recordings of audiovisual works and phonogram;
  • Data about the holders of copyrights and related rights to the audiovisual works and phonograms.

Vendors are also required to provide customers with the following information about copies of movies:

  • Number and date of the rent certificate issued according to the procedure set by Russian legislation;
  • Movie title, country and studio that shot this movie and year of its production;
  • Basic movie characteristics (genre, annotation, data about the screen writer, producer, composer, main cast and so forth);
  • Length of the movie (in minutes);
  • Recommendation for audience's age in accordance with the rent certificate (if any).

91. Before delivery to the selling room (place where items sold), copies of audiovisual works and phonograms shall undergo pre-sale preparations, including checks of every commodity unit's packaging for integrity and for availability of information about the product and its producer. An absence of such information prevents the producer from meeting the requirements of Clause 90 hereof in full.

92. When giving the product to a customer, the vendor shall check this product's packaging for integrity, and upon the request of the customer, the vendor shall let him/her watch/listen to parts of the audiovisual work or phonogram.

93. Audiovisual works and phonograms shall be sold only in the producers' packaging."

Amendment to be included in the Regulations for Licensing Reproduction (Manufacture of Copies) of Audiovisual Works and Phonograms on Any Media, approved by RF government decree No. 381 dated June 4, 2002 (approved by RF government decree No. 421 dated July 12, 2003)

Clause 3, Sub-clause "a" should read as follows:

"a. A licensee shall adhere to normative and technical standards for technical quality of copies of audiovisual works and phonograms, as well as standards for their design, including:

 

  • Required indication of the licensee's name and the license number on the case of the audio and video cassettes or on the inner circle around the hole on the scanned side of the disk;
  • Required data about the holder of copyrights and related rights to audiovisual works and phonograms and about technical characteristics of the audio or video medium of the audiovisual work or phonogram on the copy of the audiovisual work and phonogram.

This information is placed when copies of audiovisual works or phonograms are produced."
