| CALL TO ACTION ON UKRAINE ADVERTISING LAW 5 February 2004 Dear CIPR Members and Friends, We are pleased to inform you that on February 3 the Verkhovna Rada (Parliament) of Ukraine passed, in the second reading, an amendment to the Law of Ukraine “On Advertising.” The language of Article 6 of the law, which required that registered trademarks be duplicated into Ukrainian in all forms of advertising, was amended and now reads as follows: - Usage of language in advertising is conducted according to the Law of Ukraine “On Languages”;
- Marks for goods and services are used in advertising in that form, which is legally protected in Ukraine, in particular Article 6 of the Paris Convention for the Protection of Industrial Property.
As you are aware, despite international and business opposition, President Leonid Kuchma signed the bill “On Advertising” into law on September 15, 2003, with some modifications. Shortly thereafter, the CIPR Ukraine team approached MPs Yuriy Artemenko and Mikhailo Rodionov, Chairman of the Rada Subcommittee on Intellectual Property, to propose an amendment to the recently adopted law. Messrs. Artemenko and Rodionov agreed to initiate the amendment, which was registered in Parliament on September 23 and supported by the relevant parliament committees as well as the Cabinet of Ministers. Since then, CIPR Ukraine has been lobbying multiple committees with the assistance of local CIPR members and IP experts.
